Bargaining under the Fair Work Act

Find out about changes to bargaining under the Fair Work Act. This course covers the legislative changes to bargaining under the Fair Work Act and what these changes mean for workers. The course looks at the implication of these changes on devising a planning framework for bargaining.  

Who is it for?
This course is designed for Organisers with direct responsibility for bargaining. It may also be useful for senior delegates involved as part of the negotiation team.

Aims

  • To explain the legal background to bargaining provided by the Fair Work Act;
  • To integrate the bargaining strategies with the organising/growth strategies of the Union;
  • To create a framework for achieving good outcomes in the bargaining process;
  • To determine benchmarks to measure and evaluate the bargaining process.

Learning Outcomes
At the end of this course participants will be able to:
  • Identify legislative requirements for agreements, types of agreements and the way in which they have changed under the new act;
  • Identify the requirements to attract protected action status;
  • Apply the steps required to attain protected action status;
  • Identify the powers of Fair Work Australia to intervene in bargaining
  • Develop bargaining plans;
  • Research and analyse a bargaining strategy, identify potential risks and determine methods for addressing those risks;
  • Apply strategies to involve delegates and activists into bargaining campaigns;
  • Apply benchmarks as a mechanism to measure and evaluate bargaining;
  • Identify employer strategies
